LET'S BE GENDER EQUAL

EMPLOYERS, PAY ATTENTION TO THE NEW LAW ON GENDER EQUALITY

The Law on Gender Equality ("Official Gazette of the RS", No. 52/2021) entered into force on June 1, 2021.

Upon entry into force of the Law on Gender Equality, the Law on Gender Equality ("Official Gazette of RS", No. 104/2009) ceased to be valid.

The new law retains the obligations of the Employer who employs and/or engages for work more than 50 persons in relation to the measures and/or deadlines for drafting the Annual Plan and/or Program and/or Reporting on gender representation with the Employer.

The legislator now prescribes that the deadlines for submitting the Annual Plan and/or Program and/or Reporting on gender representation with the Employer are 15 and/or 30 days from the date of amendments and/or they fall on January 15 and/or January 31, depending of the document type.

The new law also specifies other obligations of the Employer, which are related to the application of the Labor Law, the Law on Personal Data Protection and/or other regulations, and which are especially related to the protection of the Employee during absence from work due to pregnancy, maternity leave, leave for child care and leave for special child care and/or upon the Employee’s return from leave, as well as the obligation of the Employer to inform the Employees once a year about the position of women and men employed or engaged for work by the Employer and/or to record gender-disaggregated data within the meaning of Article 65 of the New Law, as well as other obligations prescribed by the New Law.

The competent Ministry is expected to publish and/or prescribe the layout of the data recording forms.

The SD Office is competent to provide full legal support regarding the implementation of all provisions of the New Law on Gender Equality.
